The matter at the reported property was discussed again on 04/09/2026 with Legal and it was determined that the city would not have cause to issue a Notice of Violation letter regarding Title 20. Staff did learn that the State of Indiana requires any person who sells 11 or more motor vehicles during the course of a year to obtain a motor vehicle dealer's license. Such license would require the sign-off of the local zoning authority (City Planning in this case) to be valid. Planning staff have not received a request to authorize a dealer's license for this address, so that indicates that the resident is either selling less than 11 motor vehicles per year, or they're avoiding the notice of the Secretary of State's office somehow. Good Morning, thank you for reaching out with your concern regarding the previously reported property on S Palmer AVE. This matter was previously escalated to our Assistant Director, and she has been in communications with complainants regarding this property. A recent report was also sent to Parking Services, it appears, so they can monitor the roadway as Planning has no jurisdiction over the right-of-way. Staff will continue to monitor the area, but as previously indicated Planning staff are not able to escalate enforcement actions unless there is evidence of a business ongoing. Individuals are allowed per code to have a vehicle be repaired lawfully at their property for up to 30 days. Previous inquiries with the property owner resulted in attesting that all vehicles were plated and owned by the property owner.
