Council review of the City's Unified Development Ordinance (UDO)

In 2019, the City of Bloomington Common Council considered a proposed update to the City’s Unified Development Ordinance (UDO). The UDO contains all of the land use and development regulations that apply to construction in the City. This webpage provides information about the Council’s review process, public meetings, and other materials related to the UDO.

 

Summary of previous actions/meetings

 

  • On September 23, 2019, the Plan Commission voted 9-0 to recommend adoption of an amended UDO to the Common Council. A copy of the Adoption Draft that was certified to the Common Council can be found here or attached to the right. Pursuant to state law, the Common Council will review the Adoption Draft and either adopt, reject, or amend it.   • On October 2, 2019, the Common Council introduced Ordinance 19-24 - To Repeal and Replace Title 20 of the Bloomington Municipal Code entitled "Unified Development Ordinance”  for first reading. The Council announced that it intended to further consider the proposed UDO at future meetings and approved a schedule of meetings, which is attached to the right.

 

  • On October 16, 2019, the Common Council reviewed and heard public comment on Chapter 1 (Ordinance Foundation) and Chapter 2 (Zoning Districts) of the proposed UDO. The Council also adopted a motion on the conduct of its deliberations, which is attached to the right.

 

  • On October 22, 2019, the Common Council reviewed and heard public comment on Chapter 3 (Use Regulations) of the proposed UDO.

 

  • On October 23, 2019, the Common Council reviewed and heard public comment on Chapter 4 (Development Standards & Incentives) and Chapter 5 (Subdivision Regulations) of the proposed UDO.

 

  • On October 30, 2019, the Common Council reviewed and heard public comment on Chapter 6 (Administration & Procedures) and Chapter 7 (Definitions) of the proposed UDO. The Council also heard and considered written objections filed pursuant to I.C. 36-7-4-606(c)(3). The Council is scheduled to hear and consider additional written objections at its meeting on December 18, 2019 before a final vote on the proposed UDO.

 

  • On November 13, 2019, the Common Council considered Amendment 03 (defeated) and Amendment 05 (adopted). The Council also began consideration on Amendment 01, but did not take final action on the amendment.

 

  • On November 14, 2019, the Common Council considered Amendment 01 (adopted) and Amendment 06 (adopted).

 

  • On November 19, 2019, the Common Council considered the following amendments:
    • Amendments 10, 11, 12, 14, 15, 16, 20, 21, 22, 28, 31, 35, 39 (adopted via consent agenda)
    • Amendments 08, 13, 17, 18, 19, 24, 25, 29 (adopted)
    • Amendments 26, 27, 30 (defeated)
    • Am 09 (withdrawn)

 

  • On November 20, 2019, the Common Council considered the amendments listed below. It also scheduled a Special Session on December 3, 2019 at 6:00 p.m. to consider additional amendments.
    • Amendments 32, 33, 34, 37 (adopted)
    • Amendment 38 (defeated) 

 

  • On December 3, 2019, the Common Council considered the following amendments:
    • Amendments 41, 43, 44, 46, 49, 54, 56, 58, 59 (adopted via consent agenda)
    • Amendments 47, 48, 50, 52, 57 (adopted)
    • Amendments 40, 42, 51 (defeated)
    • Amendments 45, 53 (withdrawn)

 

  • On December 10, 2019, the Common Council considered the amendments listed below. It also cancelled the December 12 and December 17 Special Sessions.
    • Amendments 62, 65, 66, 67, 68, 69 (adopted via consent agenda)
    • Amendments 60, 61, 63, 64, 09-R (adopted)

 

  • On December 18, 2019, the Common Council considered the amendments listed below. The Council also heard and considered written objections filed pursuant to I.C. 36-7-4-606(c)(3).
    • Amendment 71 (adopted via consent agenda)
    • Amendments 45-R, 70-R, 72, 73, 74 (adopted)

 

Final Council action on Ordinance 19-24 as amended - To Repeal and Replace Title 20 of the Bloomington Municipal Code entitled "Unified Development Ordinance” 

On December 18, 2019, the Council voted 9-0 to adopt Ordinance 19-24 as amended. The Council will now return the amended UDO to the Plan Commission for its consideration pursuant to IC 36-7-4-606.
