Nuisance Lights:

Other: There is a light on the property that neighbors my house that violates the light trespass laws. It sits high on a pole in their back yard and subsequently illuminates my backyard as well as both bedrooms in my house. This light is extremely bright and because of this we have had trouble sleeping due to the light coming in to our bedroom. Also because of this light we have not been able to enjoy sitting on our back porch in the evenings due to the light shining directly in to our eyes. I’ve also talked to the neighbor on the other side of the house and she is having issues as well with the light shining on her property. The property that owns the light is currently vacant. I’d like for something to be done about this as it has become a major nuisance to my household.

Planning staff have received this report and it is on our investigation list. Please note that our enforcement process takes some time as we cannot just issue tickets for violations. It involves investigating the complaint and issuing a letter to the property owner/representative. Compliance timelines for violations are two weeks from the date the letter is issued. If we do not receive a response and the violation is not corrected, we reinvestigate after that 2 week deadline and escalate enforcement to a regular Notice of Violation letter with fine deadlines for violations. If the violation still persists, a Notice of Violation and Fines letter is issued. We have a team of two enforcement people for the entire City and respond to complaints in order of severity and date received. I understand this is a very frustrating issue for you. We will do our best to address this issue as soon as possible. Please note that we do not typically enter private property without permission and investigate complaints from the adjacent road/alleyways. If the light is not visible from the street, it can make it more difficult for us to address these types of issues. If you are willing to allow Planning staff to enter your property to get photos of this light, please give us a call at 812-349-3423 or email us at [email protected] and we can coordinate a time for a site visit.
