Thank you for your patience while we researched the situation. The photo you provided shows a new sidewalk set back from the roadway to create a new greenscape between the sidewalk and the curb. Usually, this greenscape is planted with street trees, and we often call it the tree plot. However, at this location there is an existing public water line in the street near the east curb, and due to regulations to prevent conflict between utility infrastructure and new tree plantings, trees cannot be planted in this particular greenscape. Even without street trees, the greenscape is still required by the City of Bloomington Unified Development Ordinance (UDO) and the separation between the sidewalk and the roadway still provides comfort and safety for people using the sidewalk. The photo shows that the greenscape installation is not yet complete, and is still in a condition that is not very aethetically pleasing. Because street trees cannot be planted in this greenscape, the approved plans require the builder to plant six new small street trees behind the sidewalk. As shown in the photo, these trees have not been planted yet. The site plan, including the sidewalk and greenscape, was reviewed by the Board of Zoning Appeals (BZA) during their public hearing on June 26, 2025 when they approved petition ZR2025-06-0076, conditional use approval for a duplex in the R3 zoning district. The site plan was then reviewed and approved by planning department staff as certificate of zoning compliance CZC2025-09-2292, issued on August 22, 2025. The sidewalk and other work in the right-of-way was reviewed and approved by engineering department staff as part of right-of-way use permit ROW2026-04-2458. The approved plans show the public alley on the north side of the property as paved in asphalt, which appears to have not yet been done according to your photo.
