open #205910

City Performance:

Other: Re case #205719 the full inquiry was not addressed. This is still being advertised as an event venue. This is ongoing in a neighborhood not zoned for this. How is this particular property and individual allowed to do this? Will all residents in any zoning district then be allowed to operate any business they would like despite zoning regulations?

Thank you for your inquiry. We have investigated this case and worked with the property owner, who has worked with neighbors in good faith, to set acceptable parameters that will not violate noise standards, will not generate income for the property owner, and will not be publicly advertised, thus not meeting the standard of a business. The property owner has also made arrangements with neighbors for parking. We are satisfied with the outcome. It is not illegal for musicians to gather indoors with friends and family or to play acoustic music outdoors, as long as it does not violate noise ordinances. There is no egregious history of noise violations at this address, and the birthday gathering cited in your earlier inquiry was a private event with around 20 attendees and violated no ordinances or laws. All reasonable efforts have been made to follow ordinances and to work with neighbors.
