Under City Code, smoking is prohibited in City park facilities, City vehicles, enclosed spaces, and other certain areas listed in code 6.12.030. The location described in your uReport does not describe an area where smoking is prohibited. The litter in that area has been sent to Parks for their knowledge and clean-up. Any suspicious behavior may be reported to the Police Department's non-emergent line (812.339.4477). Thank you, again, for using uReports to share your concerns regarding our community.

Hey Audrey - under Parks policy smoking is only prohibited in parks facilities and vehicles, not on Parks property generally. Under city code, the space must be enclosed in some fashion or be one of the outdoor areas under BMC 6.12.030(D). I don't think this situation fits any of the spaces under the code. I don't think the incident reported violates any policy or city code. Let me know if you think otherwise.

Hey Aleks- not trying to just put this off on you- can you find out if we have a "no smoking" policy at Parks? If so, could you check in with the appropriate division director to see if we refer this to the police (who enforced most of our parks policies) or what their process for this is, if any? Thank you!
