After looking carefully into old Plan Commission files, I was unable to find any answer to the question. There are indications that the plat for Sherwood Green Phase 2, which created the common area lot encompassing the cemetery, was approved by the Plan Commission sometime in 1974 and a replatting was approved sometime in 1976, I was not able to find any documentation or even case numbers for those approvals. The location of the cemetery is noted on the recorded plat for Sherwood Green Phase 2 Section 2D (Monroe County Recorder's Book 6 / page 105 A; Plat cabinet B / envelope 212) but there are no further details in the plat about the cemetery. Because the property is owned by the Sherwood Green Homeowner's Association, I would presume (in the absence of documentation otherwise) that the homeowner's association is responsible for maintenance of the cemetery in accordance with state law [IC 23-14-78-4(d)]. There are cases [IC 23-14-68-3] where the maintenance of a privately owned cemetery may be the duty of the township trustee, but I expect this is not the case for this cemetery since it is not listed on the Perry Township Trustee's map of township-managed cemeteries: https://www.perrytownship.info/cemeteries.html

We will look into whether the Planning and Transportation Department has information about the maintenance of this cemetery. There is of course a possibility that we do not have any such information, but we cannot know until we take a look.

I had no idea there was a cemetery here. It looks like this parcel is owned by the Sherwood Green Homeowners Association. I am going to route this to the planning department to see if they have any further insight on ownership or covenants, etc.
